Since Augustover businesses have been inspected by the City, more than in any other jurisdiction in Alameda County. Unlike the sanitary sewer system, the storm sewer system discharges directly into the San Francisco Bay without water treatment. As Berkeley has an older, more established industrial area, with a greater amount of intermixed non-industrial uses than do newer areas, it is possible that the updated General Plan can justify additional restrictions in the siting criteria.
The largest single facility covered by the regulations is the Lawrence Berkeley Laboratory with 4, employees. There will have to be a contractor responsible for operating the facility, and arranging for the recycling and disposal of the material collected. The tank must be monitored for leaks and built such that a leak from the primary container into the secondary container will be detected.
Risk Management and Prevention Plan The Risk Management and Prevention Plan RMPP required by the State's LaFollette Bill must outline any potential for mechanical or system failure that would result in a release of hazardous materials, detail maintenance and safety training programs and records, and include an analysis or "worst case" scenarios of a total release of the chemical due to a natural, man-made or technological event.
Hazardous Materials Disclosure Businesses who store hazardous materials above a certain level, as set forth by City regulation, must report their chemical inventories to the City. Currently, these permits only regulate point source discharges and do not address non point sources.
Many site clean-ups can take several years to complete. Businesses must have proper spill control equipment so that in the event of a spill occurring from a fire or earthquake, hazardous materials can be stopped from entering the municipal storm drain system.
